Section 01

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you — the parent, legal guardian, or adult student ("you" or "Family") — and Flourish Schools, LLC ("Flourish Schools," "we," "our," or "us"), a private school network operating campuses in Arizona.

By enrolling a student, accessing our website at flourishschools.com, or using any Flourish Schools programs, services, or communications, you agree to be bound by these Terms. If you do not agree, please do not enroll or use our services.

Section 02

Eligibility & Enrollment

Flourish Schools serves students in grades 3–8. Enrollment is subject to availability, completion of our application process, and acceptance by Flourish Schools at our sole discretion.

Enrollment is formalized upon:

• Submission of a completed enrollment application
• Receipt of required student records and immunization documentation
• Execution of the Enrollment Agreement and payment of any required fees
• Acceptance of these Terms of Service

Flourish Schools reserves the right to decline or revoke enrollment for conduct violations, non-payment, or any reason permitted under applicable Arizona law.

Section 03

Student & Family Conduct

Flourish Schools is committed to maintaining a safe, respectful, and inclusive learning environment. All students and families are expected to:

• Treat all students, staff, and visitors with dignity and respect
• Comply with the Flourish Schools Student & Family Handbook (incorporated herein by reference)
• Refrain from bullying, harassment, or discrimination in any form, including online
• Communicate concerns through appropriate school channels
• Arrive on time and comply with campus attendance, drop-off, and pick-up policies

Violations of conduct standards may result in disciplinary action up to and including disenrollment, at Flourish Schools' discretion and consistent with Arizona law.

Section 04

Tuition, Fees & Payments

Tuition rates, fees, and payment schedules are set forth in the Enrollment Agreement provided at the time of enrollment. By enrolling, you agree to pay all applicable tuition and fees by the dates specified.

• Arizona ESA: Flourish Schools accepts Arizona Empowerment Scholarship Account (ESA) funds. Families using ESA funds are responsible for ensuring proper submission through the Arizona Department of Education.
• Late Payments: Accounts overdue by more than 30 days may result in suspension of enrollment privileges until the balance is resolved.
• Refunds: Refund eligibility is governed by the terms of your Enrollment Agreement. Tuition paid for a given period is generally non-refundable after the period begins unless otherwise stated in writing.

Section 05

Privacy & Student Data (FERPA / COPPA)

Flourish Schools is committed to protecting the privacy of all students in accordance with applicable law, including the Family Educational Rights and Privacy Act (FERPA) and, where applicable, the Children's Online Privacy Protection Act (COPPA).

• Education Records: Student education records are maintained confidentially and disclosed only as permitted or required by FERPA.
• Parental Rights: Parents and legal guardians have the right to inspect, review, and request amendment of their child's education records.
• Third-Party Tools: We may use third-party educational technology platforms. We ensure vendors comply with applicable student data privacy laws. We do not sell student data.
• Communications: By providing your contact information, you consent to receive school communications via email, phone, and SMS. You may opt out of non-essential communications at any time.

Section 06

Photo, Video & Media Release

Flourish Schools may photograph or video-record students during school activities for use in school communications, our website, social media, and promotional materials.

By enrolling your student, you grant Flourish Schools a non-exclusive, royalty-free license to use your student's likeness in such materials, unless you submit a written opt-out request to your campus director. Opt-out requests will be honored prospectively upon receipt.

Section 07

Digital Tools & Technology Use

Students may be provided access to digital tools, learning platforms, and devices as part of their educational experience. Students and families agree to:

• Use school-provided or school-assigned digital resources only for educational purposes
• Refrain from attempting to access unauthorized content or systems
• Comply with the Acceptable Use Policy outlined in the Student Handbook
• Report any inappropriate content, security concerns, or device issues to school staff promptly

Misuse of digital resources may result in loss of technology privileges and/or disciplinary action.

Section 08

Health & Safety

The safety and well-being of our students is our highest priority. Families agree to:

• Provide current and accurate immunization records as required by Arizona law
• Notify the school of any medical conditions, allergies, or special health needs
• Keep students home when they are ill and follow the school's illness and return-to-school guidelines
• Authorize Flourish Schools staff to seek emergency medical treatment for your student if you cannot be reached in an emergency

Flourish Schools maintains campus safety protocols and may update health policies in response to guidance from Arizona public health authorities.

Section 09

Intellectual Property

All content on the Flourish Schools website and in school materials — including text, logos, graphics, curriculum, and project frameworks — is the property of Flourish Schools, LLC and is protected by applicable copyright and trademark law.

Student work created as part of school projects remains the intellectual property of the student. Flourish Schools may use student work samples (without personally identifying information, or with family consent) for educational and promotional purposes.

Section 10

Disclaimers & Limitation of Liability

Flourish Schools takes reasonable precautions to provide a safe and high-quality educational environment. However, to the fullest extent permitted by Arizona law:

• We make no warranty that our programs will produce specific academic or developmental outcomes.
• We are not liable for indirect, incidental, or consequential damages arising from your use of our services.
• Our total liability to any Family for any claim arising out of or related to these Terms shall not exceed the tuition paid for the then-current academic term.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under Arizona law.

Section 11

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify enrolled families via email and post the updated Terms on our website with a revised effective date.

Continued enrollment or use of Flourish Schools services after notice of changes constitutes your acceptance of the updated Terms. If you disagree with changes, you may withdraw your student in accordance with the withdrawal procedures in your Enrollment Agreement.

Section 12

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona, and both parties consent to the jurisdiction of such courts.
